|
At the time WVU Hospital was transferred to a private corporation, the employees were given the option of becoming corporate employees or retaining their status of Board of Regents employees. These grievants are classified as food service workers II under the BOR personnel classification system. In adopting a new classification system , the corporation collapsed the positions of food service worker II and food service worker III. FSW III is now the entry level position under the corp. personnel classification system. The adoption of a new classification system by the corp did not result in any changes of duties or salary of the corporate employees. A subsequent salary increase realized by the corporate employees was a result of union negotiations completed prior to any changes made in the classification system. Board of Regents employees may not be deprived of opportunity for promotion on an equal basis with corporate employees. WV Code 18-11C-4(d).
