|
CB POLICY was found to require the selection of the best qualified person for coaching positions. The school principal who recommended the hiring of a track coach engaged in favoritism. W.Va. Code 18-29-5(b) empowers a hearing examiner to fashion a remedy suitable to the circumstances to correct the identified error. The G was awarded the position but the CB was ordered to repost the position and evaluate the applicants consistent with state law and county board policy. Note 7 indicates that 18A-4-8b(a) is not applicable to the selection of coaches. Assignment of teachers to extracurricular duties is with discretion of CB. Hawkins v. Tyler
