Synopsis
|
Grievant alleged she was more qualified than the successful applicant for the position of Supervisor of Vocational Education and, indeed, the successful applicant was not qualified since she was ineligible for a supervisor's permit. Respondent contends that West Virginia Board of Education Policy 5202 establishing the permit requirements is arbitrary and capricious and not mandated by statute. DECISION: GRANTED. West Virginia Board of Education has the authority to promulgate policy such as 5202 and Policy 5202 is not unreasonable for the supervisor's permit, she was the only qualified candidate.
