Synopsis
|
Grievant was dismissed from his employment for touching and kissing a 16-year-old co-worker. Respondent presented testimony of the co-worker and also testimony of other female co-workers that Grievant had made improper sexual remarks and touchings. Grievant had been suspended previously for sexual harassment and warned that another incident would result in firing. Grievant denied all incidents. DECISION: DENIED. That 16-year-old may have been molested by her father did not make her testimony that Grievant kissed her not credible. Grievant's testimony, contradicted by the testimony of all the other witnesses, was not credible. Dismissal upheld.
