Synopsis
|
There was no evidence presented that counselor of DVR and WCF performed significantly different duties and AFSCME v. Civil Service Commission of West Virginia (AFSCME I) mandates equal pay for equal work. The abolishment of Rehab Counselor position would have the affect of granting substantial rights to employees who have not timely pursued those rights through the grievance procedure and the adjustment of salaries is the only appropriate remedy. GRIEVANCE GRANTED as to uniformity of pay provision provided by W.Va. Code 29-6-10.
