|
All 8 Directors were paid different salaries. R agreed G should receive a higher salary and had done all he could to get the Board to raise her salary but did not think they should all be paid the same. G alleged a uniformity violation and a violation of state and federal civil rights statutes. The discrimination claims are not reached but in a footnote the decision touches on jurisdictional questions relating to the Board hearing HRC claims and claims based upon federal statutes and expresses doubt in that regard. Previous Board cases are cited on this point and for the rule that attorney's fees cannot be awarded at this level. The case holds R estopped from relying on a timeliness defense, as G deferred filing on the basis of the Superintendent's representations. See Steele v. Wayne CB. The case also holds that G must prove uniformity violation by preponderance of the evidence and cites Turner V. Grant CB and Wright v. Putnam CB.
