G contended that a third grade teaching position became vacant and was filled without posting and sought to have the position declared vacant and filled as required by 8b(a). R argued the case was untimely because she waited until a new principal was assigned to the school who indicated no positions would be posted. G's delay in filing was found to be due to excusable delay under the particular facts of that case. The evidence showed that a vacancy had been filled w/o posting by way of a intrabuilding transfer.
