Synopsis
|
Grievants were hired in 1984 as a result of the Medley class action which resulted in the DOE assuming the educational responsibilities of persons in Dept. of Health facilities, such as Colin Anderson Center. Grievants had previously been employed at the center by the Dept. of Health in various capacities and were given service credit for salary purposes only if they had worked in the education program. Several additional employees were given credit regardless of whether they had worked in the educational program. The disparity was found to be discriminatory and to violate the uniformity statute. Furthermore to reduce the salaries of the later hired service employees would violate the relegation provisions of 18A-4-8. Grievants were granted a retroactive salary adjustment.
