Synopsis
|
G', custodian, charged with sleeping on the job, was suspended for neglect of duty. G contends he was resting on his regularly allotted free time. DECISION: WV CODE 18A-2-8 requires a board of education to prove by a preponderance of evidence the grounds for a suspension. Since evidence showed that custodians could take their breaks at times they selected and could do what they wished during the breaks, there was no evidence that grievant was not on break and therefore neglecting his duty. GRANTED.
