|
Grievant, an aide, was denied a Chapter I teacher's aide position because she lacked communication skills considered a necessary qualification therefore. Grievant alleges she was entitled to the position since she was the most senior candidate. DECISION: DENIED. A new provision, W.Va. Code 18A-5-8(d), allows expansion of the Code 18A-4-8b(b)'s definition of 'qualifications' for an aide position. Since the added qualification was reasonably necessary for effective performance of the duties of a Chapter I teacher's aide, there was no impropriety.
