Synopsis
|
Pursuant to a reduction-in-force action the BOE eliminated the position of Transportation Assistant Director and terminated Grievant employment. The Asst Trans Director position was created when the responsibilities of the Transportation Division expanded and no significant reduction in the responsibilities has occurred. The Board's justification for eliminating the Asst Transportation Dir position was to save the salary of the position. Grievant and bus operators were not evaluated during the 87-88 school year. The Dir of Trans is unable to carry out all the responsibilities of his position and those of the Assistant Transportation Director as well. DECISION: Grievant has proved by a preponderance of the evidence that the decision to eliminate the position by a RIF was arbitrary and capricious and Grievant is entitled to reinstatement.
