|
Grievant, a teacher-coach, protests his non-selection for a position opening as Athletic Director. Both grievant and the successful candidate, Mr. Bell, were deemed equally qualified for the position by the Board but it contended that Mr. Bell's county teaching experience exceeded grievant's experience and earned him the position. DECISION: The Board's reliance on teaching seniority and service to award the position was misdirected and not in conformance with W.Va. Code, 18A-4-8b(a). GRANTED: the Board improperly considered Mr. Bell's teaching seniority to give him an edge for the Athletic Director's position while grievant possessed superior qualifications for the position.
