Synopsis
|
Grievant, teacher, filed a grievance alleging a violation of W.Va. Code 18A-4-8b(a) when she was not selected to fill a teaching position although the most senior applicant. Original position posting made by the Board of Education was erroneous and Grievant qualified for the position under that posting. Upon reposting, Grievant no longer qualified. DECISION: DENIED; Board made an accurate decision that Grievant was not qualified. Under W.Va. Code 18A-4-8b(a), decisions of a county board of education affecting the filling of vacant positions must be primarily based on qualifications.
