|
Grievant, a teacher for 14 years and in various coaching positions for 12 years, alleges violation of W.Va. Code 18A-4-8b(a) when the Board did not fill the vacancy of head basketball coach on the basis of qualifications. Grievant contends the extracurricular position should have been filled on the basis of qualifications and that he was more qualified than the Board's selection. The successful applicant has 3 years teaching experience and no coaching experience. DECISION: GRANTED to the extent that the board of education is hereby ordered to conduct re-evaluation of the qualifications of the applicants. The requirement that professional positions be filled on the basis of qualifications is an employment right and must be followed when coaching positions are filled. Grievant has proven that the selection process was flawed.
