|
Grievant, teacher, tendered her resignation effective January 23. Respondent refused to accept it before January 30, and the Superintendent warned her that if she failed to work between January 23-30, he might recommend her dismissal for willful neglect of duty. She did not report after January 23 and her dismissal was recommended before January 30. DECISION: This Grievance Board is without jurisdiction. W.Va. Code 18A-2-8 requires the Board of Education to act on, and adopt, such recommendations before a 18-29-2(a) grievance exists.
