Grievant had worked as a substitute secretary since 1982 and in 1985 bid on a Secretary III vacancy but a new hire was appointed to the position. Grievant relied on her seniority.
DECISION: 8b(b) requires persons who hold class title to be given first opportunity for appointment only. The statute does not require the substitute to be hired over a new hire. The Board did not alter job description by requiring word processing ability. Retesting her for the position in the same classification is lawful. Shorthand and word processing skills were necessary for the position. Grievant was found to lack necessary skills.
