Synopsis
|
Grievant application for advancement to the MA +30 salary classification was denied on the basis of an amendment to 18A-4-4. State Dept of Educ. was joined as a party and filed a motion to dismiss. This motion is denied as it is acknowledged that the interpretation and exercise of judgment of the Department of Ed is entitled to great weight unless clearly erroneous is applicable herein because Grievant specifically alleges an erroneous interpretation and application of Code. Grievance denied: Grievant failed to demonstrate that the application of this provision is discriminatory or that he is among the class of teachers contemplated by the amendment.
