Synopsis
|
Grievants allege that they were deprived of a planning period for the 85-86 school year and ask for compensation for teaching without a planning period during 85-86 at a rate of 16.6% of their daily salary per day. W.Va. Code 18A-4-14 requires that every teacher employed for more than one half of the class periods of the regular school day shall be provided at least one planning period during the school day. This period is to be the length of the usual class period in the school, but never less than thirty minutes. As the grievants were required to teach throughout the day, planning would have to be entirely conducted on their own time. These individuals were required to work longer hours than teachers who had a planning period, yet they received the same salary. Opinion of the Circuit Court: Grievants were allotted the planning period required by Code 18A-4-1; that the Grievants are not entitled under the statute and the facts of this case to any additional compensation.
